AURION is powered by Shopify, which provides ecommerce infrastructure used to deliver portions of the Services.

However, purchases made through the AURION store are transactions between you and AURION.

Shopify is not the seller of AURION products and is not responsible for fulfilling orders, issuing AURION refunds, or handling claims relating specifically to products purchased from AURION, except to the extent required by applicable law or Shopify's own obligations.

Section 21 — Dispute Resolution; Binding Arbitration; Class Action Waiver

21.1 Agreement to Arbitrate

You and AURION agree that, to the extent legally permitted, disputes, claims, or controversies arising from or relating to:

will be resolved through binding individual arbitration rather than a court proceeding, except as provided below.

This arbitration agreement is governed by the Federal Arbitration Act.

21.2 Exceptions

Either party may:

Bring an eligible individual claim in small claims court, provided the claim remains in that forum.
Seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights or prevent unauthorized use of the Services.

21.3 Informal Resolution First

Before commencing arbitration, the party initiating the dispute agrees to provide the other party with written notice describing the dispute and relevant contact information.

The parties will have 60 days to attempt to resolve the matter informally.

21.4 Arbitration Procedure

Arbitration will be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, as modified by these Terms and applicable law.

Unless otherwise agreed, arbitration will be conducted in English.

Where permitted by applicable rules, hearings may take place:

In the county where the customer resides
By telephone
By video conference
Through another format permitted by the AAA

The arbitrator may award remedies available under applicable law, subject to the limitations of the individual dispute.

21.5 Arbitration Fees

Payment of filing, administration, and arbitrator fees will be governed by applicable AAA rules and applicable law.

21.6 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND AURION AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR MEMBER OF ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

An arbitrator may not consolidate multiple persons' claims unless permitted by applicable law and agreed by the parties.

If this waiver is found unenforceable as to a specific claim or requested remedy, the affected portion may be severed while the remaining claims continue as otherwise required under this Section.

21.7 30-Day Right to Opt Out

You may opt out of the arbitration agreement and class action waiver within 30 days of first accepting these Terms.

21.8 Survival

This Section survives termination of these Terms and closure of your account.

These Terms and any separate agreements relating to the Services will be governed and interpreted in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Subject to Section 21 and applicable law, disputes not required to proceed through arbitration will be brought in a court of competent jurisdiction in Wyoming where legally permitted.
